ASUU Files 14 Grounds of Appeal Against FG

The Academic Staff Union of Universities has filed an appeal challenging the ruling of Justice Polycarp Hamman of the National Industrial Court Abuja which ordered the lecturers to call off their seven-month-old strike and return to the classrooms.

The Counsel to ASUU, Femi Falana, SAN based their appeal on 14 grounds.

The appeal which Falana made available to The PUNCH was also accompanied by a request for stay of execution on the ruling by Justice polycarp Hamman.

The PUNCH reports that the NIC had in a judgement that was delivered last Wednesday by Justice Polycarp Hamman, ordered the striking varsity lecturers to return to the classroom, pending the determination of a suit the Federal Government filed to query the legality of their strike action.

The interim injunction directing ASUU members to resume work, followed an application FG filed through its lawyer, Mr. James Igwe.

Justine Hamman held that the order was both in national interest and for the sake of undergraduates in the country that have been at home since February 14.

He held that the strike action was detrimental to public university students that cannot afford to attend private tertiary institutions.

One of the grounds of appeal filed by the union through its counsel goes thus, “The learned Trial Judge erred in law and thereby occasioned a miscarriage of justice when he decided to hear and determine the Respondents’ motion for interlocutory injunction when he knew or ought to have known that the substantive suit filed by the Claimant was not
initiated by due process of law.

The appeal also faulted the judge’s order that the strike was an infringement on the right of students.

The appeal further stated, “The learned trial Judge erred in law when he held that the roll over strike is an infringement of the right of the Nigerian students and the government who is the owner of the universities.

The learned trial judge erred in law and occasioned a miscarriage of justice when he granted the order of interlocutory injunction in favour of the Respondents without exercising his discretion judicially and
judiciously.

“The learned trial judge erred in law in holding that ‘there is no doubt that the balance of convenience tilts in favour of the Claimants/ Applicants’.

“The learned trial judge erred in law when he held that ‘there is no undue delay on the part of the Respondents in bringing the application for interlocutory injunction’.

“The learned trial judge erred in law when he held that ‘pursuant to Section 17 of the Trade Dispute Act, Section 18(1) E mandates the members of the Defendants/Respondents not to take part in any strike pending the determination of the suit”.

To promote Equity, Fairness and Justice we can’t Support Tinubu or Atiku- Afenifere

The leader of the pan-Yoruba socio-political organisation, Afenifere, Chief Ayo Adebanjo, has disclosed the group’s reason for not supporting the presidential candidates, Bola Tinubu and Atiku Abubakar.

Adebanjo said in a statement on Monday that Afenifere stands on justice and fairness and believes in true federalism and the Federal Character principle.

The group has been receiving backlash since announcing it was supporting the candidacy of Peter Obi.

Adebanjo, however, said in the statement that Afenifere “is the Yoruba interpretation of the social welfarist ideology of Action Group, a political party founded by Chief Obafemi Awolowo and his colleagues in 1951 with strong advocacy for federalism as the best form of government to give the federating units the requisite autonomy to thrive and peacefully compete among themselves for the ultimate development of Nigeria.”

He said other founding fathers of Nigeria — Sir Ahmadu Bello, Dr Nnamdi Azikiwe, and Chief Obafemi Awolowo — agreed to the system with the endorsement of colonial secretary Sir Oliver Littleton in 1954 “and embodied in the 1960 independence constitution. This is the modest contribution of Afenifere in shaping Nigeria into a federation where no person or ethnic nationality is oppressed.”

The nonagenarian said Afenifere had always advocated and insisted on restructuring of the country “long before the parties conducted their Conventions to elect their National Executives and candidates,” and had proposed “a synthesis of the identical Resolutions of the 2014 National Conference and the APC El-Rufai 2018 True Federalism Committee.”

Adebanjo said Afenifere and the Southern and Middle Belt Leaders Forum “unanimously proposed that the minimum condition for a peaceful transition from the disastrous eight years of Buhari’s government headed by a President of northern extraction was to have the next President from the South,” a position which, he said, was supported by southern governors irrespective of their political parties.

He added, “In this quest for peace, based on equity and inclusiveness, the Yoruba took the first turn at the zoning arrangement in 1999, and that led to the emergence of Chief (Olusegun) Obasanjo, the current Vice President is a Yoruba man and equity forbids us for presuming to support another Yoruba person for the presidency in 2023.

“The current President is a Fulani from the North-West and by virtue of the zoning arrangement that has governed Nigeria since 1999, power is supposed to return to the south imminently.

“The South-West, as I have pointed out, has produced a president and currently sits as VP, the South-South has spent a total of six years in the Presidency, but the Igbo people of the South-East have never tasted presidency in Nigeria, and now that the power is due back in the South, equity demands that it be ceded to the Igbo.

We cannot continue to demand that the Igbo people remain in Nigeria, while we at the same time continue to brutally marginalise and exclude them from the power dynamics.”

Adebanjo, therefore, condemned the ceding of the PDP presidential ticket to “a Northern Fulani Muslim to succeed General Muhammadu Buhari, another Fulani Muslim, who will soon complete eight years of uneventful and disastrous rule. One can imagine such a high degree of political insensitivity.”

The Afenifere leader also stated that the group would not jettison equity, inclusiveness and justice just because one of their own — Asiwaju Bola Tinubu — was in the contest.

“We will not compromise this principle of justice, equity and inclusiveness because one of our own Asiwaju Bola Tinubu is a frontline candidate,” Adebanjo said.

Adebanjo, who said Afenifere had “no apologies but due courage of our conviction that Nigeria can only prosper in righteousness,” reiterated that, “To keep Nigeria one, everyone should be Obi/Datti compliant,” and advocated that that should be the slogan henceforth.

Buhari calls for Festus Keyamo’s Removal for De-marketing his Administration on National TV

Not satisfied with the choice of words of Festus Keyamo, President Muhammadu Buhari and members of the Aso Rock cabal have called for his removal as the spokesperson for the All Progressives Congress (APC)/Bola Ahmed Tinubu Presidential Campaign Council.

SaharaReporters quoting a presidential source, said Buhari and members of the cabal accused Festus Keyamo of always de-marketing the current administration despite being a serving minister.

“Buhari has asked for the removal of Festus Keyamo as the party’s campaign spokesperson. The President accused him of always de-marketing his regime, describing the government in which he is a minister as a failed regime. He has been described as a loose cannon who is daily demarketing his regime as a failed regime. The cabal members are not happy,” the source said.

For instance, on Sunday, during an interview on Channels Television, Keyamo said Nigerians are hungry and can’t wait to have a new leader who would satisfy their hunger.

When asked to discuss the APC’s campaign issues for the 2023 elections, Keyamo said, “Nigerians are hungry, they want to see how that hunger will be addressed, not how their Christian faith or Muslim faith will be addressed.

They want to see our policies on agriculture and what Asiwaju has done before as governor of Lagos state, how he improved Lagos and how he will bring that kind of dexterity to Nigeria as a whole.

“That is what they want to see. How do we want to run the country? What do we want to tell Nigerians?”

Secretary to the Government of the Federation (SGF), Boss Mustapha was also said to have insisted on his removal following the latest interview on Channels Television.

The SSG had to insist on Keyamo’s removal after his reckless outburst on Channels TV yesterday (Sunday). They have already informed the party leadership about this,” the presidential source added.

APC Reward System is poor, They Reward Cowards, On-lookers, Layabouts- Joe Igbokwe

A chieftain of the All Progressives Congress, in Lagos State, Joe Igbokwe, has expressed worry over the class of people the party recognises, stressing that APC reward system is poor.

Though Igbokwe didn’t mention why he made the statement, but it’s coming shortly after the party released its Presidential Campaign Council (PCC) for the 2023 general elections.

The 422-member council list, was released on Friday by the PCC Secretary, James Faleke; a member of the House of Representatives.

The likes of Femi Fani Kayode, who defected to the APC last year and Senator representing Enugu East Senatorial District, Chimaroke Nnamani, who is a member of the PDP and the candidate of the party (PDP) for Enugu East senatorial zone made the list.

Reacting, Igbokwe in a post on his Facebook page said, ”All things considered APC Nigeria poor reward system in Nigeria worries me to the marrows.

The party rewards idle people, hangers-on, layabouts, interlopers, cowards, onlookers etc.”

After 48 hours the list was released, the former governor of Enugu State is yet to distance himself from the inclusion of his name in the list.

The Chief spokesperson of the APC presidential campaign council, Festus Keyamo dismissed insinuations that the name of Senator Nnamani  appeared as a member of their Campaign Council in error.

Appearing on Channels Television’s Politics Today on Sunday, the junior minister of Labour said there has not been any refutal from the other side (Chimaroke Nnamani’s), adding that that’s where it should come from if the addition of that name is rejected.

ISWAP Claims Responsibility for the Murder of Two Igbo men in Kano

The Islamic State-backed faction of Boko Haram, the Islamic State West Africa Province (ISWAP), formerly known as Jamā’at Ahl as-Sunnah lid-Da’wah wa’l-Jihād has claimed responsibility for the killing of two businessmen in Kano State.

Gunmen on Saturday night killed the duo around Azubros Plaza, off France Road, Sabongari in Kano.

The deceased are Ifeanyi Elechukwu, aged 41, who was the target of the attack and his friend, Chibuille Emmanuel, 33, who was shot in the leg, but eventually died at a private clinic in the state capital.

Elechukwu, a battery dealer, was said to have been lured to his shop by one of the gunmen, who pretended to be a customer. He was shot at close range and killed while his friend was chased and also shot.

However, ISWAP in a statement said the attack was carried out by “soldiers of the caliphate”.

The terror group described Elechukwu as a Nigerian Army spy.

The latest claim by ISWAP comes a few days after it said its men attacked police checkpoints in Ondo and Edo states.

ISWAP had claimed expansion into Abuja, Kogi, and Taraba in the last six months.

FG Secretly Making Moves to Sell Electricity Transmission Company

The Federal Government is currently making arrangement to put the Transmission Company of Nigeria, up for sale.

The fresh quiet move comes on the heels of stalled negotiations between the Federal Government and the National Union of Electricity Employees as the latter threatens to shut down the economy.

A source close to the matter, on Thursday, told The PUNCH, on condition of anonymity, that talks to resolve pending disputes between the workers and the Federal Government had hit the rocks, and was “currently not yielding the desired results.”

The Federal Government is quietly negotiating with buyers to sell the TCN. The process will be announced soon,” the source had said.

The workers have, for the second time, threatened to shut down the national grid over unmet demands by the Federal Government.

According to the Zonal Organising Secretary, North-West, NUEE, Comrade Dukat Ayuba, while briefing newsmen in Kaduna on Thursday, explained that although negotiation was still ongoing, the group would embark on a fresh strike.

He described the privatisation process as a scam.

He added, “That was why we kicked against privitasing the distribution sector, because the investors don’t have the capacity and expertise. As committed Nigerians, we advised the government against it. But the government was hellbent on doing so.”

According to him, investors were still operating with obsolete equipment dating back to 35, 40, and 50 years, stating that one would expect that with their coming, they would replace the obsolete equipment but nothing had been done.

He regretted that the nation still generated 5,000 megawatts of electricity, saying that it was the same old 5,000 megawatts, with no benefit from privatisation.

General Secretary, NUEE, Joe Ajaero, who confirmed findings about stalled negotiations, said no agreement had been reached.

“No agreement yet. They are playing pranks. To compute the money they owe, they said their database is corrupted. Even the meeting of today has been put off,” he said.

2023 Election: Tinubu Campaign List Out, Osibanjo, Dogara Name Missing

Following weeks of anxiety and serial postponements, the presidential campaign council list of the flagbearer of the ruling All Progressives Congress, Asiwaju Bola Tinubu, was released with several notable names of party chieftains missing.

The 422-man list has names of political heavyweights including APC governors, ministers, lawmakers, ambassadors as well as serving and past public office holders.

In the latest list released by the Presidential Campaign Council Secretary, James Faleke, in Abuja on Friday night, Plateau State Governor, Simon Lalong, retained his position as Director-General just as Deputy Director-General (Operations), Adams Oshiomhole, and Director of Media and Publicity, Bayo Onanuga.

However, there are shocking omission of party stalwarts, many of whom have been at loggerheads or engaged in cold war with Tinubu over his preference for the contentious Muslim-Muslim ticket.

They include Vice President Yemi Osinbajo, former Speaker of the House of Representatives, Yakubu Dogara; former Secretary to the Government of the Federation, Babachir Lawal; former Minister of State for Education, Chukwuemeka Nwajiuba and one of Tinubu’s sweat merchant, Adebayo Shittu, who heads one of his biggest support groups — Asiwaju Tinubu-Shettima Coalition for Good Governance.

While the camp of Osinbajo had distanced itself from the former Lagos governor after his emergence as winner of the APC presidential ticket, the duo of Dogara and Lawal had remained a perennial thorn in Tinubu’s flesh for selecting ex-Borno Governor Senator Kashim Shettima, a fellow Muslim, as running mate.

Dogara had predicted on Tuesday that the adoption of a Muslim-Muslim ticket was a fruitless political effort that was “doomed to end in spectacular failure.”

The ex-speaker made the statement while delivering his keynote address at a summit tagged ‘Meet The Church,’ organised by the Nigeria National Christian Coalition.

Lawal, on the other hand, vowed that the introduction of a same-faith ticket by the APC was a deliberate plan to further create divisions in the north.

The disgruntled former SGF, who spoke during an interview on Arise Television, declared that he was working with about 40 Christian leaders in the north to ensure that the contentious APC ticket failed.

Despite defending his principal stoutly on all fronts including live political television programmes, Shittu’s sin remained largely unknown.

However, The PUNCH gathered that loyalists of the APC national leader have always seen the former Minister of Communications as an outsider because he “found his way into the party” through Congress for Progressive Change, one of the few political platforms that merged to form the current All Progressives Congress.

Shittu had told our correspondent in a recent interview that, “Why I think people often regard me as an outsider was probably because I was never a member of Alliance for Democracy, Action Congress or Action Congress of Nigeria. Besides, it has not been on record that I have a fight with Tinubu, even though critics who are jealous of my current achievements in the struggle to ensure success for him, out of pettiness and rivalry, have been trying to paint me black and blackmail me with the same slogan of ‘I am one of Tinubu’s enemies.’

But I am happy and proud to say that Tinubu, as an experienced politician who knows his onions, has always maintained that Shittu is not an enemy. The fact that we never worked together in the past does not translate to being an enemy. In any case, he is also somebody who appreciates what I have been doing.”

 

The inclusion of former Rivers State Governor, Rotimi Amaechi, and Minister of Interior, Ogbeni Rauf Aregbesola, who have been indicted of alleged anti-party activities in the last month has come as a surprise.

While Amaechi had subtly accused Tinubu of financially inducing delegates for votes at the last Convention, Aregbesola was believed to have worked for the victory of the governor-elect of Osun State , Ademola Adeleke, at the expense of the incumbent and fellow party member, Adegboyega Oyetola.

Faleke’s statement on Friday read, “We are pleased to announce the nominees of the leadership of the APC Presidential Campaign Council, as per enclosed. All nominees are kindly advised to pick their appointment letters from the undersigned on Monday, 26th September, 2022 at 12noon.

“The venue is Tinubu-Shettima Presidential Campaign Council on Plot 781, Herbert Macaulay Way, Central Area Abuja. All other members will be contacted by the leaders of their respective directorates.”

Why I Joined the “Obidient” Movement- Charly Boy

Entertainer and activist, Charles Oputa, popularly known as Charly Boy, has provided his reason for joining the ‘Obidient’ movement ahead of the 2023 general elections.

According to the 72-year-old activist, who spoke to Akelicious during the week, the current administration has failed Nigerians and has given no hope for the common man. hence the search for change.

Charly boy believes strongly that Peter Obi, a former Anambra State Governor and presidential candidate of the Labour Party, LP, would bring about the socio-economic changes the country requires to move from where it is now.

It is about bad governance and how to change that equation and status quo,” the veteran entertainer told Akelicious in an interview.

Charly Boy further stated that Nigerians must change their mindsets towards those they elect into power, insisting that one of the biggest problems is that the people remove themselves from governance and feel it is not their business and do not mount pressure on their leaders to do the right thing.

He also said that nothing would change if Peter Obi goes in there and Nigerians still maintain the ‘nothing concern me’ mindset.

“You know when you get to a certain position, you need a certain discipline and know how to guide yourself; if not, you are hijacked by psychopaths and these psychopaths know the game and will cage you and hold you to ransom.

“I believe this country lies in the hands of the youth and they have to fight.

There’s this mindset of ‘my thief is better than your own thief; as far my thief is in government it is ok’.

When I am not benefiting it becomes a problem and we start attacking ourselves. That is why they play their game so well in the sense of using tribal sentiment, religious bigotry to further divide us.

We have to do what we have to do. I will tell the young people that they are gaining momentum and they have the population. That is the strength. They are technically savvy although these criminals are using the same young people

“When we have more people on the side of the truth, maybe something will happen.

“Nigerian youths understand the situation and are dealing with it. The rigging I hear some people are planning.

“I hear there is a plan going on, which is vote buying. Some people intend to collect the money and vote their conscience. The only place we have a major problem is the rigging.”

PETER OBI: THE DIFFERENCE BETWEEN A MOVEMENT AND PARTY CAMPAIGN- Dr Adamu Akyala Ishaku

Peter Obi is not running a campaign. He is leading a movement.

Let me tell you the difference in case you don’t know.

1. Campaigns end as soon as the results of elections are announced. Movements continue thereafter.

2. Campaigns are driven by politicians while movements are driven by the people.

4. Campaigns are driven by interest while movements are driven by convictions

4. In Campaigns people follow a politician selfishly because they believe he/ she will win but in movements, the people follow selflessly because they believe the people will win.

5. In campaigns ,people follow a person while in a movement people follow ideology.

6. In campaigns politicians tell the people what they will do but in a movement the people know what the person they are following will do.

7. In a campaign, people who cast their vote believe they are doing a politician a favour but in a movement they know they are doing themselves a favour.

8. In a campaign, politicians build structures but in a movement the people build the structure and infact,everyone is a structure.

9. In campaigns we rely on politicians to convince us to get involved,we have people with apathy but in a movement people find motivation from within. Everyone is bold.

10. Campaigns come with a plan from day one but Movements don’t. They are spontaneous. They build momentum that becomes the plan.

11. Campaigns are like T.V advertisement politicians pay to get people in, but a movement is like a premiership match,the people pay to get in at their own expenses.

12. In a campaign people who oppose you or make a caricature of your campaign are usually confident but in a movement,people who oppose you or make caricature of the movement are scared of it.

PETER OBI IS A MOVEMENT. I AM PART OF THAT MOVEMENT. BE ALSO A PART OF THE MOVEMENT.
NOW IS THE TIME. STAND UP AND BE COUNTED .”

Ayu Collected N1Billion Bribe from a presidential Aspirant- Wike Spill

Nyesom Wike, governor of Rivers, says Iyorchia Ayu, national chairman of the Peoples Democratic Party(PDP), received N1 billion from one of the presidentialhopefuls in the party.

The governor made the allegation during a media chat on Friday.

He said Ayu is corrupt, and that the chairman cannot deny that he received the money but refused to remit it to the party’s account.

“Ayu is very corrupt. I’m totally informed. Ayu has theopportunity to challenge me, I will name,” he said.

Some of the governors can tell you. Will he deny thefact that he didn’t collect N1 billion from Lagos? Let him deny it, I will tell him who gave him the money not from the Lagos state government, the money was given to him in Lagos.

“He met one of the presidential candidates and told him that he’s not sure these governors may want to sponsor the party.

That money did not enter into the account of PDP, but we are not attacking Ayu on that basis.”

Wike had contested the PDP presidential primary election in May but lost to Atiku Abubakar.

Other hopefuls in the primaries were Bukola Saraki, former senate president; Bala Mohammed, Bauchi governor; Udom Emmanuel, Akwa Ibom governor; Pius Anyim, Sam Ohuabunwa, Ayodele Fayose, and Dele Momodu.
