Breaking News: *Court Orders Police To Pay CharlyBoy Fifty Million Naira, Apologize Over Attack During #ResumeOrResign Protest*
A Federal High Court sitting in Abuja presided over by a Hon. Justice John Tsoho in a landmark judgment delivered on Monday 22nd October, 2018 has ordered the Nigeria Police Force, the Inspector General of Police and the Commissioner of Police F.C.T. Command to pay the sum of 50 Million Naira and publish an apology in Two National Newspapers to popular musician and activist, Mr. Charles Oputa alias Charly Boy.
In the suit filed on the 29th of March, 2018 by his lawyer and human rights activist, Mr. Inibehe Effiong to enforce his fundamental rights, the 67-year-old popular musician gave a graphic account of how policemen numbering over 100 from the F.C.T. Police Command invaded the Unity Fountain in Abuja on the 8th day of August, 2017 and attacked him and his group with teargas canisters, hot water cannon and wild police dogs during the Resume or Resign protest when he led other activists to protest the prolonged absence of President Muhammadu Buhari from Nigeria on account of his medical vacation in the United Kingdom.
Charly Boy further narrated that the attack by the policemen was so severe that he collapsed in the process and was rushed to the hospital.
He also stated that the police attacked them because of claims that their protest over the President’s absence, which had exceeded 90 days on the second day of their daily sit-out protest, had gone international and brought serious embarrassment to the country.
Delivering judgment on Monday in the case marked as Suit No. FHC/ABJ/CS/343/2018 between Charles Oputa versus The Inspector General of Police & 2 Others, Justice Tsoho held that there was no evidence that miscreants invaded or stormed the premises of the protest as alleged by the police.
On whether the Applicant is entitled to stage the protest, the court held that protest is a constitutionally guaranteed right provided it is done peacefully and that even if miscreants were on the scene to hijack the protest, the Respondents possess enough security measures to dislodge such persons and maintain law and order.
‘’The Respondents (the Police) need not exercise an uncommon aggression and mayhem to wade off alleged miscreants’’ Justice Tsoho ruled.
According to the court, the Respondents admitted in their Counter Affidavit that it was in the bid to protect members of the public and public properties from the ‘’miscreants’’ who suddenly took over the protest that the men and officers of the Respondents had to use teargas canisters and hot water Canon in order to disperse the hoodlums. But that the Respondents stated that the teargas and water Canon were not directed at the Applicant.
This assertion according to the court, lacks substance as teargas circulates and affects all persons within the premises. And the atmosphere generally affected which causes cough.
The court found that the Applicant has disclosed a reasonable cause of action against the Respondents and that the Respondents violated the Fundamental Rights of the Applicant to dignity of the human person, freedom of expression, peaceful assembly and association as enshrined in Sections 34, 39, and 40 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended).
‘’The law is that the court has the right to grant redress to anyone whose right is violated and the Applicant is entitled to a remedy.’’ said Justice Tsoho.
‘’Relief 4 is granted and the Respondents are ordered to publish an apology to the Applicant in 2 National Newspapers for violating his Fundamental rights. The sum of 50 Million Naira is awarded against the Respondents as General and Exemplary damages.’’
The court also ordered perpetual injunction against the Respondents from violating the fundamental rights to dignity of the human person, freedom of expression and peaceful assembly and association.
Reacting to the judgment, the Applicant’s counsel, Inibehe Effiong described the judgment as a resounding victory for democracy, freedom of expression and peaceful assembly in the country.
‘’This judgment sends unequivocal message to the Nigerian Police that they have no power to stop or disrupt peaceful protests by Nigerians. The police by this judgment cannot invent flimsy excuses to stop citizens from exercising their fundamental rights to freedom of expression and peaceful assembly. I am highly elated by this victory for democracy.’’ Effiong said.
Reacting to the judgment, the National Secretary of the OurMumuDonDo Movement, Comrade Raphael Adebayo, in a statement said that the judgment has raised the confidence of Nigerians in the judiciary.
‘’The OurMumuDonDo Movement wishes to express satisfaction over the judgment of the Federal High Court in Abuja on the unprovoked attack of the police on its members during the ResumeOrResign Protest. This development is a sign that the Nigerian judiciary is indeed committed to upholding the supremacy of our country’s Constitution.’’
‘’We also wish to thank Justice John Tsoho for his sagacity in handling this case, just as we are grateful to our team of young, vibrant, and courageous lawyers who have tirelessly worked on this case to get us to where we are right now.’’
‘’We wish to state unequivocally, that this victory is not only for the OurMumuDonDo Movement but also for every Nigerian who believes that a new and better Nigeria is achievable. We strongly hope that by virtue of this victory, Nigerians will feel more emboldened to speak truth to power, hold leaders accountable, and resist fear in advocating for issues of social order and social justice in our great country.’’ The statement read.
The Respondents were represented in the case by O. M. Atoyebi and M. D. Podos while Inibehe Effiong along with S. M. Oyeghe represented Charly Boy.

Mazi Nnamdi Kanu ,the leader of IPOB has vowed to return to Nigeria but rejected facing trial in what he described as “a Kangaroo court.”
Kanu, in a broadcast on Radio Biafra, yesterday evening, reiterated he would come back to “Biafraland” but was silent on when he would return.
The IPOB leader, who had been missing since last year, was sighted in Israel, on Friday, praying in a Synagogue.
Video clips of that outing went viral and when its authenticity was doubted, Kanu indicated he would make a live broadcast, which he did, yesterday evening.
He said: “They wanted to intimidate us. They wanted to murder us into submission but, they failed comprehensively because we are IPOB and I am Nnamdi Kanu. No mortal flesh can kill me. They have not given birth to that very person but I shall return. I assure you.
“I said it in 2015 that I would go back to that very country and I returned. I assure you that I am coming; you’ll know that definitely. Since they didn’t want me to come to court, I will come back to Biafraland.
“They have failed and they will continue to fail. They can murder us as much as they like but, any day we decide to retaliate, the world shall bear us witness. Their intention was to kill me to ensure that I didn’t go to court; (because) they knew that if I go to court, that very country will never be the same again. To cover their shame, they hastily arranged to kill me. They asked me to call off the Anambra election boycott. I told South East governors that they should go and get me something from Abuja; they should get me a date for a referendum.
“There was no date for a referendum; there was nothing tangible at all about devolution. You want me to call off boycott and I said no!
“I make bold to say that my forced unavailability deserves an evidentiary hearing in a competent court of law; not in a Kangaroo court where all the details will be ventilated, to determine the legal impact of that very attack on my ability to make myself available to the court as required. That such a hearing was never allowed to hold in (Justice) Binta Nyako’s court was not only disappointing and that’s the cause of the current impasse. As someone out on bail, why would the Nigerian government want to kill me and pretend or lied that I jumped bail when I am a ward of court and, therefore, deserved the protection of the court?
“I decree that that there is no longer South East or South South Nigeria. It shall be known as Biafra. Without referendum, nothing will happen. IPOB will not participate in any election and that position will never change…”
Meanwhile, First Republic Aviation minister, Mbazulike Amechi expressed joy that Kanu is alive.
“If he said something complementary about me in his broadcast as you have informed me, that is good. I don’t have much to say other than we thank God that he is alive. We are happy. The military didn’t mean well for him…” he said.
On his part, Bishop Abraham Chris Udeh, in Nnewi, Anambra State, said: “We have been on 40 days fasting and prayer for God to grant us the kingdom East, which is Biafra. It was on the 20th day of the programme that Nnamdi Kanu resurfaced. I’m not a member of any pro-Biafra group but I strongly believe in Biafra.
“Well, the resurfacing of Kanu, Biafra is very close. Giving the Igbo the position of VP is not what we want. It is Biafra and that is where we stand.”
Like the voice of a raging lion, his voice thundered and the British colonial contraption called Nigeria trembled, the false foundation holding Nigeria was threatened.
His name is Nnamdi Kanu.
Following his incarceration by Buhari led government, a widespread of protest erupted across Nigeria especially in the south east, demanding for his release.
His courage saw him through and the bars of Nigeria prison gates could no longer hold him down. There was Jubilation across the land as the man of the moment storms out of prison.
He vowed it is Biafra or Death, and indeed many died defending his quest for Biafra freedom.
At this point, Nigeria armed forces under the command of Buhari, descended on South East with Operation Python dance… it was horrific, blood sorrows and death became the new order. Once again, brave Biafran youths made good their vow, it is Biafra or Death.
Nnamdi Kanu Disappeared with his parents, the flags were lowered, Biafra people were declared terrorist and the hope for freedom seems to have come to an end.
Like the second coming of the messiah, prophecy was made about his return.
Today, we have seen that prophecy come through, and he is set to address his followers from Israel.
Now he must address these questions if truly, he is whiter than white.
Who is behind his Disappearance and sudden reappearance?
Is his return an act of God or Politically motivated?
What about Election boycott, will he stand on it or will he work towards terminating Buhari’s government by 2019?
Who will benefit from his decisions and actions – Biafra or Nigeria.

INTERNATIONAL PRESS CONFERENCE ON THE NOMINATION OF HIS EXCELLENCY, MR PETER OBI AS THE VICE PRESIDENTIAL CANDIDATE OF THE PEOPLES’ DEMOCRATIC PARTY (PDP) BY HIS EXCELLENCY ALHAJI ATIKU ABUBAKAR AND OTHER RECENT POLITICAL DEVELOPMENT IN NIGERIA.
Ladies and Gentlemen of the Press.
We welcome you to this International Press Conference.
On October 12th. 2018, the news came to us that Alhaji Atiku Abubakar, the Presidential candidate of the Peoples Democratic Party has chosen Mr Peter Obi, the former Governor of Anambra State as his Vice Presidential running mate in the forthcoming Presidential Election in the Federal Republic of Nigeria. After brief consultation the President of ADF was mandated by the leadership of Alaigbo Development Foundation to issue a brief statement stating that ADF welcomes the nomination of His Excellency, Mr Peter Obi and congratulating His Excellency, Alhaji Atiku Abubakar and his running mate.
We followed by sending text messages to our brothers who were said to be complaining about the procedure of the nomination to withdraw their opposition and support Mr Obi’s nomination.
Since then, we have received several questions particularly from some of our members as well as the broad spectrum of Umuigbo world-wide asking for clarification on the ADF action. Some of the questions being asked are the following:
Why Mr Peter Obi?
Why Mr Atiku Abubakar?
What will be the impact of their Presidency on the Igbo predicament in the Federal Republic of Nigeria?
How does this action of ADF relates to the mission of ADF which Umuigbo have increasingly come to identify with globally?
What is more, the large bulk of Umuigbo who have lost faith in the Federal Republic of Nigeria and are asking why ADF should be supporting the 2019 election whose result will not guarantee the quest for Self-determination for Alaigbo and other nationalities who are clamoring for a political union in which they are now trapped as slaves.
Will this development not abort the quest for freedom?
Yes, why Alhaji Atiku Abubakar, a Fulani man and a Moslem like Buhari. Although he rides on the banner of Restructuring, he has not clearly clarified his proposal for Restructuring. By the way, is it Restructuring that will resolve the century-old predicament of Ndigbo in Nigeria. Are we not intending to prolong Igbo predicament and suffering in Nigeria?
They are also asking can Atiku Abubakar and Peter Obi win the election that has been so badly skewed to return Buhari?
Ladies and Gentlemen, it is for the sake of clarifying these crucial but very legitimate questions amongst other issues that the leadership of Alaigbo Development Foundation (ADF) is addressing this International Press Conference.
Why Peter Obi?
In our brief congratulatory message to Alhaji Atiku for choosing Mr Obi as his running mate, ADF stated:
. “His Excellency, Mr Peter Obi, is one of the most Authentic,Trusted and Capable Igbo leaders through whom the continued membership of Alaigbo in the Affairs of the Federal Republic of Nigeria can be negotiated”.
Please note that ADF did not say that Mr Obi is the only person in Alaigbo worthy of such a choice by Atiku. But what is the basis of the judgment by ADF? Here is our answer.
In 2016, when nobody was thinking of Election or Nomination for the Vice President of the Federal Republic of Nigeria, the Alaigbo Development Foundation, ADF, in further pursuit of her Aku-Ruo Ulo (Invest-At-Home) Movement, decided to undertake an Industrial Tour of Alaigbo to see for ourselves the challenges facing Umuigbo in their desire to invest and develop Alaigbo. The tour took us to Nnewi and Onitsha industrial axis.
It was amazing the extensive industrial complex in Onitsha which many people do not know. This was largely, as we were informed, due to Mr. Obi’s Administration. At Nnewi, we visited the massive Innoson Motor Manufacturing Complex. Innoson told us that everyone should thank Mr Peter Obi for what we were seeing of his Industry. For a take-off, Gov. Obi gave him a contract to produce vehicles for schools and institutions in Anambra state and paid him N5b ( five billion naira ) upfront. And he delivered the vehicles before the deadline given to him. He received further similar encouragement from Mr Peter Obi.
We were also informed that one of our business gurus had his goods seized at the International Airport in Lagos. Mr. Obi flew to Abuja and got President Jonathan’s intervention and had the goods released. What about his care of the old veteran political leaders in Anambra State – the late Mathematician and political leader, Prof. Chike Obi? What about Chief Mbazulike Amaechi?
ADF still has the video of the Industrial Tour for anyone who cares to listen to it on our website. Given this character of the man, Mr Peter Obi, it is inconceivable if he would be in any regime that continues to hunt and willfully destroy Igbo businesses and Igbo businessmen – we mean the siege on Innoson, the Ibetos, the Ifeanyi Ubas, the Pascal Dozies, etc.
Mr Obi is a pragmatic business man and we expect that he will be sensitive to the basic interests of the development of Alaigbo in the interim. Someone told us that the choice of Peter Obi is premised on his vast experiences in the areas of investment, economic and social development, an area Nigeria is scoring below par at the moment.
Why Atiku Abubakar – a Fulani and a Moslem?
Many of us knew Atiku Abubakar initially through his political patron, late Shehu Yar’Adua. That was at the 1994-5 National Constitutional Conference. Yar’Adua was a Fulani and a Moslem, he was a liberal Moslem Fulani whose main allies were Southerners. His liberal outlook pitched him against the late Sani Abacha as well as the most conservative elements among the forces of hegemony. We remember the long reign of Military autocracy that culminated in the fascist regime of General Sani Abacha, a regime in which General Muhammadu Buhari served and which General Shehu Yar’Adua opposed and was killed for his opposition.
We remember the great achievements of that Conference. General Shehu Yar’Adua was at the head of the Liberal North and worked with the liberal forces in the South to initiate most of the democratic provisions meant to promote equity, justice and democratic governance in the Federation. One remembers the six geo-political zones, power-sharing and rotation of the Presidency, federal character principle and commission, new revenue allocation formula, etc, etc.
Thus, from the ideological and political point of view, we have a basis for choosing between these two Moslem-Fulani candidates – Buhari and Atiku.
What will be the impact of their Presidency on the Igbo predicament in the Federal Republic of Nigeria?
We do not expect any miracle from anyone sworn to uphold the 1999 Federal Constitution. Igbo Predicament has a long history, right from the forced amalgamation of 1914. ADF has examined this history as well as interacted with our people both at home and abroad. We also know that the song of freedom is raging in many zones in Nigeria. This is a process which neither Atiku/Obi Government nor that of Buhari regime can abort.
The fact is that there are great obstacles on the way to our freedom which we must struggle to eliminate. Issues of development of Alaigbo, homeland security and protection of our people from the menace and killings of the Fulani herdsmen, dismantling of the military siege of Alaigbo, near comprehensive elimination of our people from the federal bureaucracy, total decay of our infrastructure, hounding of our businessmen, harassment and torture of our youth, We must continue to fight against these critical obstacles to our survival as people even as we continue to press on for Regional Autonomy or total freedom for our people, We cannot wait until that ultimate goal is achieved before attending to these daily nagging challenges.
The mission of ADF is the Rebuilding and Development of Igbo Nation and the Rebirth and Advancement of the Spirit of her Culture and Civilization. Put differently, ADF works for the
Restoration of the philosophical and social values of the Igbo Society; Re-energizing and Refocusing of basic Igbo communal spirit (Umunna), together with the spirit of enterprise and individual drive (Ikenga), anchored on the fundamental moral and spiritual ethos (Ofo-na-ogu). Ndigbo have been recognized world-wide for these philosophical and social values from time immemorial.
It is in the light the above that ADF and several pan-Igbo organizations and pro-Biafra organizations on July 28, 2018 present the Enugu Declaration, the details of which shall be published in due course.
On the question of whether the Atiku/Obi ticket can win the 2019 Federal election in the light of the fact that the result of the election has been programmed to return Buhari, we in ADF dare say that Buhari can win only if the election is rigged. The election can only be rigged if the Security forces (Army, Navy, Air Force, Police, DSS, EFCC, para-military agencies) and INEC are used to rig the election. In addition, they will succeed if the courts are used to provide legal legitimacy to the result of such rigging.
Yes, all these are possible. But ADF believes that there are well-meaning personnel of these agencies whose conscience will resist this evil. It is possible that the way things are now, some of these gentlemen are already wondering where such ignoble role will land them at the end of the day. Some of them are already wondering and asking themselves what would happen to them if, at the end of the day, the Atiku/Obi ticket wins the election. Given such scenario, the possibility of successful rigging of the election in the manner of the recent Ekiti and Osun elections cannot be guaranteed.
All said and done, all efforts must be geared towards ensuring that the regime of Python Dance, jihad, ethnic and religious cleansing is defeated while the struggle for freedom must be sustained very vigorously.
. Finally, ADF would like to state quite categorically that we do not condemn anyone who honestly seeks the path of collective solidarity and collective support of Ndigbo for the nomination of Mr. Peter Obi as the Vice Presidential Candidate of the PDP, and to ensure the victory of their ticket. The trouble is only with those who, for one selfish reason or the other, seek to undermine the nomination and the victory of the ticket. There is no doubt that right now, as someone has stated, that over 95 % of Ndigbo endorse the choice. Ndigbo must now stand as one man to ensure the victory of the Atiku/Obi ticket.

In short, ADF condemns the inability of the leadership of the All Progressive Grand Alliance (APGA) to conduct a transparent Party Primary to choose their candidates for the 2019 election in Imo State.

Our worry stems from the fact that Umuigbo were beginning to look in the direction of APGA for the evolution of a political party that can effectively champion their Regional interest.
The Alaigbo Development Foundation (ADF) hereby wishes to appeal to the political class in Alaigbo not to allow their political interests and ambitions to override the fundamental interests of Ndigbo.
Biafrans who believe in legal/ political methodology to achieve self determination for the people of the former eastern Nigeria have thrown their weight behind Atiku/Obi Ticket on the basis of their promise to restructure Nigeria into Regional Governments.This was made known to the newsmen through a statement signed by the project Chairman -Barr Emeka Emekesiri.Barr Emeka Emekasiri issued the statement on behalf of the IPOB Biafra Project consisting of the following entities:
(1) The nation of the remnants of Biafra called Indigenous People of Biafra being the claimants in a representative capacity in Suit No FHC/OW/CS/192/2013 between Biafra and Nigeria in the Federal High Court of Nigeria
(2) The Customary Government of Indigenous People of Biafra being the administrative government structure for the claimants
(3) The Movement of Biafrans in Nigeria (MOBIN) being the political and diplomatic arm of the claimants
(4) The Supreme Council of Elders of Indigenous People of Biafra being the Elders’ Governing Council for the claimants.
The statement reads in full ”we received the news of the candidacy of Alhaji Atiku Abubakar and Sir Peter Obi for the 2019 presidential election in Nigeria with great joy. Nevertheless, we want to go to the root of the matter and avoid being influenced by the emotional public reactions carried by the wind of the unbridled desire to change the buharized changes. Yes, the incumbent President Muhammadu Buhari has acquired a special name for himself in the administration of Nigeria. We can now competently create words to describe his government as the buharization of Nigeria in the Nigerian political lexicon. Yes, with due respect, I say that we have been buharized enough!
We are aware that Sir Peter Obi has a vision and a mission to renegotiate Nigeria by way of devolution of power to the regions. At the launch of Nigeria’s Golden Book in Abuja in 2011, the then Governor Peter Obi of Anambra State called for the renegotiation of Nigeria in the following words, “Let’s renegotiate Nigeria”, published by The Sun Newspaper, Wednesday, 28 September, 2011. He condemned the 1999 Constitution of Nigeria and said, “I agree with Mimiko that we need to talk. We never sat down to develop this Constitution. It was entrusted on us. Every time amendment, amendment; let’s discuss that document entirely. We are either a federation or not. Let’s state where we are. This is as simple as ABC. I sit in Anambra State and get orders and instructions from somewhere else!”
At page 266 of the Book, “Biafra or Nigerian Presidency- What the Ibos Want”, published the following year in 2012, the author reported Governor Peter Obi as follows: ‘The last statement of His Excellency, Governor Peter Obi, needs some emphasis: “We are either a federation or not…I sit in Anambra State and get orders and instructions from somewhere else!” In a nutshell, he is asking for autonomy in a federation. He wants to be free to govern his people in their best interest. He is like a shepherd who knows the best care for his flock but receives contrary orders and instructions from somewhere else! He is like a medical doctor who knows the best treatment for his patient but receives contrary orders and instructions from somewhere else! He is like a lawyer who is required by law to act in the best interest of his client but receives contrary orders and instructions from somewhere else! The Governor wants the foundation of Nigeria to be restructured so that each unit would be autonomous.”
Autonomous Regional Government is our demand. We the Biafrans under the entities listed above have decided to support the Atiku/Obi candidacy not only because it appears they have listening ears and will work in the interest of the people but because their vision is in line with our vision for the Biafra Project Phase 2. In our originating summons in Suit No FHC/OW/CS/192/2013 in the case between Biafra and Nigeria, in which we had 8 prayers, our Prayer No 7 is as follows:
“An Order affirming the Memorandum of Ohanaeze Ndigbo dated 28th June 2012 submitted to the National Assembly for the restructuring of Nigeria into six autonomous self-governing regions, namely: South East, South West, South South, North East, North West and North Central, as a manifestation of the Will of the People in the exercise of their right to self-determination and directing the Defendants to present an Executive Bill to the National Assembly for a law granting autonomy and self-governing status to the six geopolitical regions in Nigeria; OR IN THE ALTERNATIVE, in the role of the Judiciary as the last hope of the common man, an Order directing the Defendants to present an Executive Bill to the National Assembly for a law dissolving Nigeria in peace along the compatible ethnic groups instead of allowing the country to break up in bloodshed”.

We still stand by this Prayer. It is either devolution of power to the regions to govern themselves as autonomous regions or peaceful dissolution of Nigeria so that we can go our separate ways! Although it appears that the Defendants have frustrated the judicial process with incessant adjournments of the case and infiltrating the body of the officers of the claimants to remove the vision bearer and destroy the case, we have activated the political process to achieve the same goal. Our political movement is the Movement of Biafrans in Nigeria (MOBIN) which is fully engaged in the Nigerian politics in the interest of the Biafrans. We shall “mobinize” all the Nigerians including the Biafrans living in Nigeria to vote for the Atiku/Obi candidacy and stop the buharization of the country. We believe in the achievement of self-determination by the rule of law and political diplomacy. All the indigenous peoples amalgamated by force to create Nigeria desire freedom. It is not only the Biafrans that want freedom. All the ethnic nationalities want freedom. It is either freedom within Nigeria just as the four countries of England, Wales, Scotland, and Ireland enjoy their freedom within Britain or freedom outside Nigeria just as Eritrea is free from Ethiopia. We are Biafrans living in Nigeria. We are Biafrans by indigenous identity but Nigerians by citizenship which was forced upon us against our will. We must maintain our indigenous identity as Biafrans in Nigeria just as the Scots, the Welsh and the Irish maintain their indigenous identities in Britain. It is a symbol of our indigenous identity as a people without prejudice to the sovereignty of Nigeria until we gain independence by due process of law.
We do not want Peter Obi to become a mere spare tyre and an errand boy in Aso Rock serving the interest of the rulers of darkness in the high places but an active partner in the decision-making process. Therefore the basis of our support to the candidacy of Atiku Abubakar and Peter Obi is the vision to restructure Nigeria into autonomous self-governing regions in line with our Prayer No 7 in the Federal High Court of Nigeria. Any type of restructuring that does not guarantee the autonomous governance of the regions will not be accepted by the Biafrans. We shall stand with Alhaji Atiku Abubakar and Sir Peter Obi as long as they stand with us in our quest for self-determination by granting our request for autonomous regional government.
